Terms of Service

By downloading, installing, or using the Divine Whisper App, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service and our Privacy Policy. These Terms constitute a legally binding agreement between you and Vaiteq Solutions (OPC) Pvt. Ltd.

You must be at least 17 years of age to use the Divine Whisper App. By using the App, you represent and warrant that:

• You are at least 17 years old.
• You have the legal capacity to enter into these Terms.
• You will not use the App if you are prohibited from receiving services under applicable laws.

3.1 License Grant

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the Divine Whisper App on your personal mobile device solely for your personal, non-commercial use.

3.2 Prohibited Activities

You agree NOT to:

• Use the App for any unlawful purpose or in violation of these Terms.
• Reverse engineer, decompile, disassemble, or attempt to derive the source code of the App.
• Modify, adapt, translate, or create derivative works based on the App without our prior written consent.
• Remove, alter, or obscure any proprietary notices (including copyright and trademark notices) on the App.
• Use any automated system, including robots, spiders, or scrapers, to access the App.
• Interfere with or disrupt the App or servers/networks connected to the App, or violate any requirements, procedures, or regulations of such networks.
• Use the App to transmit any harmful code, viruses, or other malicious software.
• Impersonate any person or entity or misrepresent your affiliation with any person or entity.

4. User Accounts

4.1 Account Registration

To access certain features of the App, you may be required to create an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.

4.2 Account Security

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to:

• Keep your password secure and confidential.
• Notify us immediately of any unauthorized use of your account.
• Ensure that you log out from your account at the end of each session when accessing the App from a shared device.

We are not liable for any loss or damage arising from your failure to comply with this section.

5. Services Provided

Divine Whisper provides AI-powered astrology readings, tarot readings, birth chart analysis, daily horoscopes, numerology insights, and educational guides. Our services are intended for entertainment and informational purposes only.

While we strive to provide accurate and up-to-date information, we make no representations or warranties regarding the accuracy, reliability, or completeness of the content provided through the App. You acknowledge that astrology and tarot readings are based on interpretations and beliefs that may not be scientifically proven.

6. In-App Purchases and Credits

6.1 Free Credits

Upon signing up, you will receive 3 free credits to explore our paid features. These credits are non-transferable and cannot be exchanged for cash.

6.2 Purchasing Additional Credits

You may purchase additional credits through in-app purchases. All purchases are final and non-refundable unless required by applicable law. Prices for credits are subject to change at any time without notice.

6.3 Payment Processing

Payments are processed through third-party payment providers (Google Play Store). By making a purchase, you agree to the terms and conditions of the respective payment provider.

7. Intellectual Property Rights

All content, features, and functionality of the Divine Whisper App, including but not limited to text, graphics, logos, icons, images, audio clips, and software, are the exclusive property of Vaiteq Solutions (OPC) Pvt. Ltd. or its licensors and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

You may not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the material on our App, except as permitted under these Terms or with our prior written consent.

8. Third-Party Services and Links

The App may contain links to third-party websites or services (such as VedicAstro API, OpenAI API) that are not owned or controlled by us. We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third-party websites or services.

You acknowledge and agree that we shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with the use of or reliance on any such content, goods, or services available on or through any such websites or services.

11. Indemnification

You agree to defend, indemnify, and hold harmless Vaiteq Solutions (OPC) Pvt. Ltd., its affiliates, and their respective officers, directors, employees, agents, and licensors from and against any and all claims, damages, obligations, losses, liabilities, costs, or debt, and expenses (including but not limited to attorney's fees) arising from:

• Your use of and access to the App.
• Your violation of any term of these Terms.
• Your violation of any third-party right, including without limitation any copyright, property, or privacy right.
• Any claim that your use of the App caused damage to a third party.

12. Termination

12.1 Termination by You

You may stop using the App at any time and may request deletion of your account by contacting us at contactus@divinewhisperapp.com.

12.2 Termination by Us

We reserve the right to suspend or terminate your access to the App at any time, without prior notice or liability, for any reason, including but not limited to:

• Breach of these Terms.
• Violation of applicable laws or regulations.
• Fraudulent, abusive, or illegal activity.
• At our sole discretion for any other reason.

12.3 Effect of Termination

Upon termination, your right to use the App will immediately cease. All provisions of these Terms that by their nature should survive termination shall survive, including but not limited to ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

13. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law provisions.

Any disputes arising out of or relating to these Terms or the use of the App shall be subject to the exclusive jurisdiction of the courts located in Bangalore, Karnataka, India.

14. Changes to These Terms

We reserve the right to modify or replace these Terms at any time at our sole discretion. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect via email or through a notification in the App.

By continuing to access or use our App after those revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, you must stop using the App.

15. Severability

If any provision of these Terms is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such provision shall be modified to the minimum extent necessary to make it valid and enforceable, or if such modification is not possible, the provision shall be severed from these Terms. The validity, legality, and enforceability of the remaining provisions shall not be affected or impaired in any way.

16. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Vaiteq Solutions (OPC) Pvt. Ltd. regarding the use of the Divine Whisper App and supersede all prior and contemporaneous understandings, agreements, representations, and warranties, both written and oral, regarding the App.
